Países diferentes encuentran dificultades parecidas en la fiscalización
La V Jornada Iberoamericana de Inspección del Trabajo, que aconteció el último martes, 24 de septiembre, dentro de la programación del Encuentro Nacional, en Victoria (ES), posibilitó el cambio de experiencias y permitió a los Auditores-Fiscales brasileños conocer la realidad de la inspección en otros países. Realizada por el Sinait, en compañera con la Confederación Iberoamericana de Inspección del Trabajo – CIIT, la Jornada contó con participantes de España, Uruguay y Argentina que fueron unánimes en afirmar que la plantilla de fiscalización brasileño está entre los mejores del mundo, a pesar de los incontables problemas enfrentados por los Auditores-Fiscales.
Para a presidente de la CIIT, la Auditora- Fiscal del Trabajo Rosa Jorge (GO), la experiencia brasileña es exitosa porque su estructura busca seguir las directrices de la Convención 81, de la Organización Internacional del Trabajo – OIT, y porque el país posee una organización sindical combativa. Los ponentes afirmaron que la fiscalización en sus países sólo avanzó a partir de la creación de sindicatos, pues ellos ayudan en el enfrentamiento de los problemas vivenciados por la categoría.
Rosa Jorge acordó aún, que el objetivo de la Jornada es traer para el Enafit las experiencias, preocupaciones y motivaciones de la inspección en otros países, además de dar oportunidad de unión no sólo de los países miembros de la CIIT, pero también de aquellos que no forman parte, pero comulgan de las mismas ideas.
Estructura eficiente
El representante de España, Carlos Moyano, afirmó que uno de los principales problemas de la inspección en aquel país es asegurar los derechos laborales en tiempos de crisis económica. En que pese las dificultades con la informalidad y las crecientes tercerizaciones, España tiene una estructura de fiscalización eficiente. Son 17 comunidades autónomas, organizadas en una estructura céntrica que coordina y dirige la inspección nacionalmente.
Además de eso, dentro de la organización de la inspección española existe la Escuela de Inspección del Trabajo, que tiene formación para inspectores iberoamericanos, con objetivo de establecer medios de conocimiento específico y buenas prácticas. Otro punto positivo es la existencia de instrumentos jurídicos para la garantía de la integridad del inspector y seguridad del trabajador. “Nuestro código penal puede suspender el funcionamiento del establecimiento que no cumplir las normas, pero tenemos muy que avanzar en lo que concierne al combate a la informalidad”, dijo.
Violencia
En la Argentina la violencia contra inspectores es un factor que preocupa. Según Sergio Neira, representante del país vecino, inspectores sufren con los constantes actos contra la vida, principalmente en las haciendas. “Aún tenemos empresarios que se consideran señores feudales. En una acción en la provincia de Entre Ríos, cuatro inspectores fueron recibidos con 23 disparos y después de accionar la policía, el hacendado fue detenido, lo que aconteció por sólo 30 días”, lamentó. En junio de este año, en la misma provincia, dos inspectores fueron recluidos en una hacienda de frutas cítricas, por tener descubierto sesenta trabajadores que vivían en el local, en situación análoga a la esclavitud. Las leyes que regulan la Inspección del Trabajo en la Argentina son recientes. A pesar de eso, consiguieron ayudar a combatir la informalidad. En 2003, 53% de los trabajadores eran informales y hoy suman 37%. Aunque hayan ocurrido avances la fiscalización queda perjudicada en función del pequeño número de inspectores.
Informalidad
La informalidad es un problema que alcanza 30% de los trabajadores uruguayos. En consonancia con Sergio Voltolini, esa situación genera varios costes para el país, entre ellos la pérdida de recaudación, aumento de la edad para la jubilación, competencia desleal, además de la carga tributaria.
Uno de los mayores problemas de la inspección uruguaya actualmente está relacionado a los trabajadores domésticos: 55% están en la informalidad. “En 2008 la Comisión de Informalidad e Inclusión Social del Consejo Nacional de Economía propuso bajar para 20% en cinco años, pero aún no alcanzamos ese objetivo”, esclareció Voltolini.
Muerte por Agrotóxicos
El Auditor-Fiscal del Trabajo Francisco Luis Lima (PI), que representó lo Brasil en el panel, habló sobre el uso abusivo de agrotóxicos, que lleva a enfermarse e incluso a la muerte de los trabajadores. Brasil es el mayor consumidor mundial de agrotóxicos y permite la venta indiscriminada de productos que están siendo proscritos de Europa.
Francisco Luis habló de las dificultades de la fiscalización en el área, ya que no hay control y criterios para la venta de los productos. Además de los problemas causados a los trabajadores y de la dificultad de fiscalización, el uso de agrotóxicos contamina alimentos y compromete la salud de la población. Alimentos como pimiento, tomate y frutilla poseen un porcentaje superior al 50% de contaminación. “Según la Anvisa, el uso de agrotóxicos no autorizados es responsable por la mayor parte de las irregularidades de los vegetales consumidos en Brasil”, dijo.
